2. Description of Service

Ad Fuse AI is a software-as-a-service platform that uses artificial intelligence to generate advertisement creatives, including images, videos, and copywriting. The Service is provided "as is" and "as available."

3. User Accounts

To use certain features, you must:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Be at least 16 years of age

We reserve the right to refuse service, terminate accounts, or remove content at our discretion.

4. Subscription and Billing

Credits: Our service operates on a credit-based system. Credits are consumed when generating ad creatives and refresh monthly based on your plan.

Billing: Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as specified in our refund policy.

Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds are provided.

Price Changes: We reserve the right to modify pricing with 30 days notice. Existing subscribers will be notified of changes before their next billing cycle.

5. Intellectual Property

Your Content: You retain all rights to content you upload (product images, logos, descriptions). You grant us a license to process this content to provide the Service.

Generated Content: Ad creatives generated using Ad Fuse AI are owned by you. You have full commercial rights to use, modify, and distribute generated content for advertising purposes.

Our Platform: The Ad Fuse AI platform, including its AI models, templates, and interface, remains our property and is protected by intellectual property laws.

6. Acceptable Use

You agree NOT to use the Service to:

• Create content that is illegal, harmful, threatening, abusive, or defamatory
• Generate ads for illegal products or services
• Create misleading or deceptive advertising
• Infringe on the intellectual property rights of others
• Distribute malware or engage in phishing
• Attempt to gain unauthorized access to our systems
• Violate any applicable advertising regulations

7. AI-Generated Content

You acknowledge that content is generated by AI and may not be perfect. You are responsible for reviewing all generated content before use. Ad Fuse AI does not guarantee that generated content will:

• Meet specific performance targets
• Be free from errors or inaccuracies
• Comply with all platform-specific advertising guidelines
• Be suitable for all audiences or markets

8. Third-Party Services

Our Service may integrate with third-party platforms (Facebook, Google, etc.). Your use of these integrations is subject to their respective terms of service. We are not responsible for third-party services or content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDRY SYSTEMS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify and hold harmless Ad Fuse AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
